    Intellectual Property Rights (TRIPS)

The Gene Campaign, New Delhi and Centre for Environment Concerns, Hyderabad adopted a Resolution at state level workshop on 'Agriculture, Food Security, and Rural Development & the WTO' demanding equity and justice from the World Trade Organisation, since the TRIPS have provisions that strike at the very heart of the fundamental rights of every citizen of the world, who have access to food, health and the means to earn a living. 

During the workshop it emerged that the TRIPS agreement hinders access to and fair equitable sharing of benefits arising from the utilization of genetic resources, creates conditions that would hinder the transfer of technology to the developing countries, put an end to innovations and practices of indigenous and local communities and it would be detrimental to the conservation and sustenance use of biological diversity. 

Hence during the workshop, demands were made to review of article 27.3(B) be one of a substantive nature, changes in the clause for disclosure be introduced in TRIPS and demanded rights to review to ensure that implementation of the TRIPS agreements supports its objectives as set out in its preamble and Article 7 as well as the broader objective of the WTO to promote trade in accordance with the objective of sustainable development. Importantly, the workshop had demanded that the WTO members should refrain from exercising unilateral pressure that aims to have developing countries implement intellectual property regimes that offer a higher level of intellectual property protection than required by the TRIPS agreement and TRIPS agreement must not interfere with a party’s legitimate implementation of its obligations.
